Following terms, further referred to as the "Free-Music Agreement", specify the rules for the use of selected free music tracks available on the Soundimage website under the name "FREE-MUSIC" further referred to as the Free-Music.
§ 1 INTRODUCTION
1. FREE-MUSIC music tracks are a separate, limited set of selected music tracks from the Soundimage offer, which are made available for use free of charge and available on the subpage http://www.soundimage.eu/free-music-for-youtube-video.html
2. Soundimage is the Licensor (data according to the regulations of the Soundimage website), who holds all copyrights, economic and related rights to Free-Music tracks.
3. The user of the Free-Music tracks is any user (further referred to as the 'User') of the Soundimage website, in accordance with the provisions of these regulations
4. Free-Music tracks are made available in the form of sound files, further referred to as the Sound Files, in wav or mp3 format.
§ 2 THE RULES FOR USE OF FREE-MUSIC TRACKS
1. User who wills to download Free-Music is required to register a customer account, providing his personal and address details and agreeing to subscribe to the Soundimage newsletter.
2. The User has the right to use the tracks to the extent described in § 3 and § 4 , provided that all of the following conditions are fulfilled by User:
a) placing the User's Production in which he used a Free-Music track on YouTube.com (publicly available)
b) including in the description (further referred to as the "Description") of the User's Production the following content:
"Music: Soundimage Music Library (http://www.soundimage.eu)"
c) sending to Soundimage the link to User's Production posted on YouTube.com within14 days after User's Production in published.
d) acceptance of subscription of the Soundimage Newsletter (during registration) and obligation to not cancel the subscription within 12 months
e) liking Soundimage profile on Facebook and following YouTube channel at:

§ 3 SCOPE OF PERMITTED SYNCHRONIZATION
1. Provided to the rules described in § 2, Soundimage grants the User with a non-exclusive license to Free-Music Synchronization (i.e. merging the Free-Music Sound File with the User's Production created by the User (referred to as User's Production or User's Productions), constituting work(s) as defined by the Act on Copyright and Related Rights only with the following User’s Productions:
a) promotional, advertising and product movies
b) presentations
c) videoblogs, tutorials, vlogs, courses
d) advertising spots
e) animations, animation movies, movies
f) documentaries, TV reportages
Mentioned above types of User’s Productions refer only to those which are published in YouTube.com and only on conditions they are published in YouTube.
§ 4 BROADCAST IN MEDIA
1. Upon terms of "Free-Music Agreement" The User has the right to broadcast the User's production only on the Internet, in particular in Youtube.com, provided to the principles described in Free-Music Agreement.
2. Broadcasts in Radio or Television or other media may be possible on condition that the User has to obtain the individual acknowledgment (hereinafter referred to as "Individual Consent"). In order to receive such "Individual Consent" the User has to send a request to Soundimage email address using contact form , in response to which Soundimage may agree to grant User an Individual Consent and will agree with User conditions of free use of Free-Music.
3. Only "Individual Consent" agreed between User and Soundimage enables User to use Free-Music in other media than Internet on conditions agreed with between User and Soundimage.
§ 5 SCOPE OF THE LICENSE - EXCLUSIONS
1. It is not allowed to use Free-Music works in any other way and in a different scope than described in § 2, §3 and §4
2. In particular, it is not allowed to:
a) produce and sell of the electronic devices with loaded Free-Music tracks;
b) granting third parties further permissions to synchronize or use Free-Music;
c) transferring Free-Music to third parties, distributing, renting or granting licenses to third parties to use Free-Music;
d) using Free-Music in whole or in part for the production of instrumental or vocal musical recordings;
e) publishing music albums containing Free-Music;
f) using the subjects of copyrights contained in Free-Music in a manner other than together with the related rights contained in them (e.g. performing of the composition contained in Free-Music and registration of such performance);
g) sharing Free-Music on streaming services (e.g. Youtube) in a way other than synchronization with the User's Production constituting a work within the meaning of copyright;
h) synchronization with works containing racist content, promoting violence, content in contrary to Polish law, vulgarisms, and inciting hatred;
i) placing Free-Music Sound Files on a website or services that allow them to be downloaded.
j) broadcast in other media than the Internet without an Individual Consent
§ 6 FINAL PROVISIONS
1. Soundimage has the right to assign rights and obligations under the agreement to a third party of its choice without the Licensee's separate consent.
2. Soundimage reserves the right to decide on the removal of the description referred to in § 2, paragraph 2 point b), in this case, Soundimage will inform the User of the need to delete the Description, and the User undertakes to immediately delete the description.
3. The user has read and accepted the terms and conditions of the Soundimage Website.
4. In the event of a breach of the provisions of Free-Music Agreement terms, Soundimage has the right to charge User for the use of the free-music contrary to the terms, in the summary amount of 300 PLN net plus Unlimited license fee for the use of the free-music track in accordance with the Soundimage price list for music tracks made available for a fee.
5. The law applicable to the Free=Music Agreement the Polish law; any disputes arising here from or related hereto shall be subject to the jurisdiction of Polish courts. The court to have territorial competence shall be the one whose district scope covers Soundimage’s address stated in the CEIDG register.
